1. Acceptance of the Terms

These Terms of Service are entered into by and between you and KillerDock, Inc. ("KillerDock", "Company", "we", "us", or "our"). The following terms and conditions govern your access to and use of killerdock.com (the "Website") and your purchase of any product through the Website. By using the Website or placing an order, you accept and agree to be bound and abide by these Terms of Service. If you do not agree, please do not use the Website.

2. Products, Pricing, and Orders

We work to describe and display our products, including colors, finishes, options, and dimensions, as accurately as possible. Colors and finishes may look different on different screens, and product visualizer images are representations, not exact renderings. Prices and availability may change without notice.

Your order is an offer to buy. We may refuse or cancel any order, including if a product is unavailable, if there is an error in pricing or product information, or if we suspect fraud. If we cancel an order after you have been charged, we will refund the amount charged.

3. Shipping, Returns, and Warranty

Orders are subject to our Shipping Policy, Return Policy, and Warranty, each of which is part of these Terms. Online orders are accepted for delivery within the contiguous United States only. For Alaska, Hawaii, U.S. territories, and military addresses, email josh@killerdock.com for a custom quote.

4. Product Installation and Use

You are responsible for the proper installation, use, and maintenance of any KillerDock product, and for complying with any laws, permits, marina rules, or other requirements that apply where the product is installed or used.

5. Hold Harmless

Purchaser agrees to defend KillerDock, Inc., its agents, directors, officers and employees, at Purchaser’s sole expense, and will indemnify and hold harmless KillerDock, Inc., its agents, directors, officers and employees, from and against any and all product liability losses, costs, damages, fees or expenses arising out or in connection with Purchaser and/or any of its family, guests, customers, affiliates or sublicensees possession, installation, use, or sale of any KillerDock, Inc. Product, including, but not limited to, any actual or alleged personal injury, property damage, death or other consequence occurring to any person or entity as a result, directly or indirectly, of the possession, installation, use, or sale of any KillerDock, Inc. Product, whether claimed by reason of breach of warranty, negligence, wantonness, product defect, or otherwise, and regardless of the form in which any such claim is made.

6. Intellectual Property Rights

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by the Company, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Prohibited Uses

You may use the Website only for lawful purposes and in accordance with these Terms of Service. You agree not to use the Website:

  • In any way that violates any applicable federal, state, local, or international law or regulation.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To interfere with the security or operation of the Website, or to attempt to gain unauthorized access to any part of it.

8. Disclaimer of Warranties

YOUR USE OF THE WEBSITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE IS AT YOUR OWN RISK. THE WEBSITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE ONLY WARRANTY THAT APPLIES TO KILLERDOCK PRODUCTS IS THE LIMITED LIFETIME WARRANTY DESCRIBED IN OUR WARRANTY POLICY. TO THE FULLEST EXTENT PERMITTED BY LAW, ALL OTHER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED.

9. Limitation on Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, INCLUDING ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT PURCHASED THROUGH THE WEBSITE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless the Company, its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Website. This is in addition to the Hold Harmless provision above.

Our Website may contain links to third-party websites that are not operated by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

12. Governing Law and Jurisdiction

All matters relating to the Website, your purchases, and these Terms of Service shall be governed by and construed in accordance with the internal laws of the State of Alabama, without giving effect to any choice or conflict of law provision.

13. Severability

If any provision of these Terms of Service is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Service will continue in full force and effect.

We may update these Terms of Service from time to time. The updated version will be posted on this page with a new "Last updated" date. Your continued use of the Website after changes are posted means you accept the updated terms.
